Buyer: exclusively a natural person acting as a consumer, outside the scope of any trade or business (the "Buyer"). The Goods are intended solely for private individuals and cannot be purchased by a business entity (on a company/company ID) - the e-commerce site does not support entering business billing details, and the Seller may refuse or withdraw from any purchase made in that manner. These Terms therefore apply in full to the Buyer as a consumer within the meaning of Act No. 108/2024 Coll. on Consumer Protection.
Goods: a symbolic, gift-style "piece of blue from the sky" (a symbolic registry entry for a 50 × 50 m location of sky above chosen GPS coordinates, recorded in the Blue From Sky Registry) together with a digital PDF Blue From Sky Registry Certificate bearing a QR code, intended as a memorabilia/gift item without any legally binding effect on real ownership, use, or any other property or personal rights to any real estate, land, airspace, or other asset. Purchasing the Goods does not grant the Buyer any actual (in particular no proprietary, ownership, neighboring, or other property) rights to the relevant territory, land, or airspace - this is exclusively a symbolic, gift, and entertainment product.
2. Conclusion of the Purchase Contract
2.1 The e-shop displays the offered Goods including description and price. Displaying the Goods constitutes an invitation to make an offer, not a proposal to conclude a contract.
2.2 The Buyer places an order by selecting GPS coordinates on an interactive map, filling in the required details, and submitting the order, which is conditional on (i) payment of the purchase price and (ii) explicit confirmation of agreement with these Terms and the Privacy Policy.
2.3 The purchase contract is concluded at the moment payment is credited to the Seller (successful completion of payment via the Stripe payment gateway), together with the Seller's order confirmation sent by e-mail to the address provided by the Buyer.
2.4 The Seller reserves the right to verify availability of the chosen GPS coordinates. Given the uniqueness of each point in the sky, two Buyers cannot select the same coordinates (the system reserves the chosen coordinates for a limited time while payment is being completed). If an order is not completed within the set time limit, the coordinate reservation automatically lapses and the coordinates become available to other buyers.
2.5 In the event of an obvious pricing error (e.g., a clearly incorrect price caused by a technical error), the Seller will notify the Buyer without undue delay. In such a case, the Seller is not obliged to deliver the Goods at the erroneous price, and either party may withdraw from the contract; any amount already paid will be promptly refunded.
2.6 Uniqueness also applies after the purchase contract is concluded: GPS coordinates that a Buyer has purchased will not be re-offered for sale to any other party in the Blue From Sky registry.
2.7 The Seller may reserve certain particularly sought-after coordinates (e.g. well-known landmarks or locations) internally in its Blue From Sky registry before they are offered for public sale, including with the intent to later offer them to an interested party at an individually agreed price. Such a reservation does not create any actual ownership or other property right of the Seller in the relevant territory, land, or airspace (the same as for the Buyer under Clause 1) - it is merely an internal designation of the coordinates as temporarily unavailable for public sale, and it creates no right for any third party.
3. Price and Payment Terms
3.1 All prices are stated inclusive of value added tax (VAT), as the Seller is a registered VAT payer.
3.2 The minimum order value (after all discounts and promotions) is EUR 5.99.
3.3 Payment is made in advance, exclusively through the secure Stripe payment gateway. Your full payment details (e.g., card numbers) are securely processed directly by Stripe; the Seller does not store them.
3.4 An order not paid within the set time limit (30 minutes from creation) is automatically cancelled and the GPS coordinate reservation is released.
4. Delivery of Digital Content (Certificate)
4.1 The Goods under these Terms constitute digital content not supplied on a tangible medium - a PDF Blue From Sky Registry Certificate.
4.2 The Certificate is made available to the Buyer immediately after successful payment processing, via a secure link (a unique, non-public access token) sent to the Buyer's e-mail address and simultaneously available in the Buyer's customer account.
4.3 The Buyer acknowledges that, given the immediate electronic delivery, proper delivery of the Goods requires a functioning e-mail address and internet access.
4.4 For every Certificate, the Seller also creates an accompanying digital record on a public blockchain network, independently verifiable by anyone regardless of the Seller. The record contains solely a cryptographic fingerprint (hash) of the coordinates and the public address of a wallet assigned to the Buyer (created and managed automatically by the Seller; the Buyer does not create or operate it themselves); it never contains the Buyer's name, e-mail address, or other directly identifying information. This record serves solely as additional proof of the Certificate's uniqueness and authenticity and does not create any separate proprietary or other rights beyond those arising from these Terms. Due to the technical nature of blockchain technology, such a record cannot be removed or altered once created.
5. Right of Withdrawal
5.1 Under Act No. 108/2024 Coll. on Consumer Protection governing distance contracts, a consumer Buyer would ordinarily have the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
5.2 However, the subject of the purchase is digital content not supplied on a tangible medium (an electronic PDF Certificate), the provision of which begins, with the Buyer's consent, before expiry of the withdrawal period (the Certificate is generated and made available immediately after payment). For this reason, and in accordance with the statutory exception applicable to digital content not supplied on a tangible medium, the Buyer loses the right of withdrawal from the moment the Certificate has been fully provided.
5.3 Before the order is bindingly submitted, the Seller expressly draws the Buyer's attention to this fact, and the Buyer must actively confirm (by checking a box) that they:
- request immediate commencement of the provision of digital content before expiry of the withdrawal period, and
- acknowledge that they thereby lose the right of withdrawal.
5.4 Reason for this exception: the Certificate is a unique, personalized digital document tied to specific, uniquely allocated GPS coordinates; its value and symbolic meaning lie precisely in its immediate issuance and uniqueness, and once made available it cannot be "returned" in the sense of returning goods - it is an intangible performance consumed by its provision. Allowing withdrawal after the Certificate has been made available would also enable abuse (downloading the content and then returning the goods without any risk to the Buyer), which is why the law expressly permits this exception for digital content.
5.5 The above does not affect the Buyer's right to claim the Seller's liability for defects in the Goods (complaints) under Article 6, nor any refund arising from causes attributable to the Seller (e.g., duplicate payment, technical error in order processing, non-delivery of the Certificate) - such claims are not the right of withdrawal and are not limited by it in any way.
6. Liability for Defects and Complaints Procedure
6.1 The Seller is responsible for ensuring that the delivered Certificate corresponds to the order (in particular the correctness of the stated GPS coordinates, name/dedication, and other data provided by the Buyer) and that it is functional and legible.
6.2 If the Certificate has a defect (e.g., incorrect coordinates caused by a system error, a non-functional/corrupted file, duplicate charge), the Buyer has the right to file a complaint at support@bluefromsky.com, stating the order number and a description of the defect.
6.3 The Seller will confirm receipt of the complaint without undue delay and will resolve it no later than 30 days from the date it was made. The Buyer will be informed of the resolution by e-mail.
6.4 If the complaint is justified, the Buyer has the right to free remedy of the defect (e.g., re-generation/correction of the Certificate), and if this is not possible or reasonable, to a reasonable price reduction or a refund of the purchase price paid.
6.5 Refund method: the Seller refunds payments using the same method by which payment was made - i.e., automatically back to the Buyer's payment card/method via the Stripe payment gateway, generally within 14 days of the reason for the refund arising. If a refund to the original payment method is not possible (e.g., the card has been cancelled/expired), the Seller will request the Buyer's bank details (IBAN) in order to refund the payment by bank transfer.
7. Alternative Dispute Resolution
7.1 If the Buyer is not satisfied with how the Seller handled their complaint, or believes the Seller has violated their rights, they have the right to contact the Seller with a request for remedy at support@bluefromsky.com.
7.2 If the Seller responds negatively to a request under point 7.1, or fails to respond within 30 days of it being sent, the Buyer has the right to file a proposal to initiate alternative dispute resolution with an ADR entity under Act No. 391/2015 Coll., in particular the Slovak Trade Inspection (www.soi.sk), or another authorized legal entity listed in the register maintained by the Ministry of Economy of the Slovak Republic.
8. Seller's Rights and Obligations
- to deliver to the Buyer a Certificate corresponding to the content of the binding order,
- to ensure the uniqueness of the allocated GPS coordinates as against other Buyers,
- to issue and deliver a tax document (invoice) to the Buyer in electronic form,
- to protect the Buyer's personal data in accordance with Article 9 and the Privacy Policy.
9. Buyer's Rights and Obligations
- to be a natural person at least 18 years of age,
- to provide true and complete information when placing an order,
- to pay the purchase price properly and on time,
- to respect that the Goods are a symbolic/gift product without any real ownership effect (Article 1).
10. Personal Data Protection
Processing of the Buyer's personal data is governed in detail by a separate document, the Privacy Policy, which forms an integral part of the relationship between the Seller and the Buyer.
11. Final Provisions
11.1 These Terms take effect on the date of their publication on the Seller's website.
11.2 The Seller reserves the right to amend these Terms at any time; contracts already concluded are governed by the Terms in effect at the time the order was submitted.
11.3 Legal relationships between the Seller and the Buyer not expressly governed by these Terms are governed in particular by Act No. 40/1964 Coll. (Civil Code), Act No. 108/2024 Coll. on Consumer Protection, Act No. 22/2004 Coll. on Electronic Commerce, and other generally binding legal regulations of the Slovak Republic, as amended.
11.4 By submitting an order, the Buyer confirms that they have read, understood, and fully agree with these Terms.
11.5 In the event of any discrepancy between the Slovak and English versions of these Terms, the Slovak version shall prevail, as it constitutes the legally binding original governed by Slovak law.
